SUBJECT: CLARIFICATION RE DIOCESAN POLICY ON ACCEPTING

APPLICATIONS FOR MARRIAGES

Dear Reverend Fathers and Monsignori:

I am writing to you again regarding our diocesan policy on accepting application for marriage of a previously married person or a foreigner.

In DOP Circular No. 2009-008, I clarified the contents of the said policy and explained its canonical basis. Recently however, more serious problems have been presented to me caused by improper or wrong implementation of the said policy. So, I wish to reiterate the most important part of the policy, namely;

No application for marriage involving a previously married person or a foreigner maybe entertained in any way without a prior clearance from the Office of the Judicial Vicar. Non-compliance to this provision can lead to very nasty consequence.

Lately, some people have approached me asking for my clearance for wedding which are already definitively scheduled to take place in “few days or couple-of-week time.” They thought that clearance from my office is just one of those documents to be submitted out of formality. They made their application some months or even a year before, but were told to get a clearance from my office just a few days before the wedding. They were even required to pay a hefty non-refundable deposit thinking that everything is already in order except for my clearance which they thought to be just a matter of formality. They already prepared everything for the wedding. Entourage of relatives and friends from abroad have already bought their plane tickets and arranged everything to come over for the wedding. Then, I found out that the marriage cannot push through because there is a pre-existing impediment of ligamen. What then? Surely, that would create a pretty messy predicament to the bride, the groom and their relatives or friends. On my part, I will appear as a heartless monster to them. But what can I do? I have no power whatsoever to change the law of the Church. All I can do is apply the law to the best of my knowledge and ability. Moreover, our diocese, God forbid! may even have to face a law suit.

So please take the above-mentioned policy seriously to avoid very unpleasant consequences.

Rev. Monsignori and Fathers:

 

Mrs. Remedios V. Cruz, mother of Rev. Fr. Rustico V. Cruz and Mrs. Teresita P. Ramos, mother of Rev. William P. Ramos passed away last February 7, 2010.

 

The remains of Mrs. Remedios Cruz lies in state at 61 Santos Street, Angat, Bulacan while Mrs. Teresita Ramos’ remains lies in state at the Santa Maria della Strada Parish, Katipunan corner Pansol Streets, Loyola Heights Quezon City.

 

Interment of Mrs. Cruz will be on Saturday, February 13, 2010 at 10:00 a.m. after the Requiem Mass (venue for which will be announced later) and the interment of Mrs. Ramos will be on Thursday, February 11, 2010 at Himlayang Pilipino in Tandang Sora, Quezon after the Requiem Mass at 8:00 a.m. at the Santa Maria della Strada Parish.

 

Let us include in our prayers and Mass intentions the eternal repose of the souls of Mrs. Remedios V. Cruz and Mrs. Teresita P. Ramos.
